The Enforcement of Document Legalisation with Apostille Certificate in Indonesia

The government has ratified the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents (Apostille Convention) through Presidential Regulation No. 2 of 2021 (Perpres 2/2021).

This convention aims to remove the conditions for diplomatic or consular Legalisation of foreign public documents or domestic public documents to be used abroad by issuing Apostille Certificates against these documents. This convention is ratified to shorten the Legalisation process for these documents so that they can be used in their jurisdiction. Apostille Legalisation can only be applied to certain documents that are enforced in certain countries.

A. Documents that can be Legalised through Apostille

Article 1 of the Apostille Convention states that the procedure for Legalising apostille can be applied to public documents:

  1. Documents originating from institutions or officials that have ties to courts of judicial bodies of a country;
  2. Administrative documents;
  3. Notary deeds;
  4. Official certificates affixed to documents signed by authorized officials

B. List of Recipient Countries of Apostille Certificates

Documents originating from ratifying countries to the Apostille Convention can be used in other countries that have ratified the Apostille Convention. As of September 23, 2022, a total of 121 countries have ratified the Apostille Convention, including:

  1. Japan
  2. South Korea
  3. India
  4. Singapore
  5. Turkey

The process of document legalisation through apostille in Indonesia is carried out online by the Ministry of Law and Human Rights at https://apostille.ahu.go.id/.  On that site, applicants for legalisation can check the types of documents that can be legalised with an Apostille Certificate, and the names of the recipient countries of Apostille Certificate.

The legalisation service has been officially implemented since June 14th, 2022. Applicants will be subject to Non-Tax State Revenue of Rp150,000 (one hundred and fifty thousand rupiah).
